Terms of Service

These Terms of Service govern your use of dakbar.com and any purchase you make from us. The site is operated by Dak Bar Whole Foods, Inc. ("Dak Bar," "we," "us"). By using the site or placing an order, you agree to these terms. If you don't agree, please don't use the site.

1. Changes to these terms

We may update these terms from time to time. The effective date above shows when they last changed. Changes apply to orders placed after the update. If you have an active subscription, we'll tell you about any change that affects it before it applies.

2. Our products

Dak Bar energy bars are made from whole-food ingredients. They contain tree nuts, peanuts, milk, butter and may contain or come into contact with other allergens. Always read the ingredient and allergen information on the package before eating. If the website and the package differ, the package is correct.

Information on this site, including nutrition information, is for general purposes only. It is not medical or nutritional advice. If you have a food allergy, a medical condition or specific dietary needs, check with your doctor before eating our products.

Our bars contain no preservatives. Store them in a cool, dry place and use them by the date on the package. Some flavors contain chocolate and can soften in heat.

3. Orders, pricing and availability

Placing an order is an offer to buy. We accept it when we ship it. We may refuse or cancel any order, for example if an item is unavailable, we suspect fraud, or there is an error in the listing.

Prices are in U.S. dollars and may change at any time without notice. If a product is listed at an incorrect price or with incorrect information, we may cancel orders for it, even after the order is confirmed and payment is taken. If we cancel an order you've paid for, we'll refund the full amount to your original payment method.

We currently ship within the United States only.

4. Payment

Payment is due when you place an order, unless you have an approved wholesale account (Section 9). By giving us a payment method, you confirm you're authorized to use it. Payments are processed by our payment providers, and we don't store full card numbers.

5. Shipping and delivery

Shipping options, costs and delivery estimates are shown at checkout and in our Shipping Policy. Delivery dates are estimates, not guarantees. Risk of loss passes to you when we hand your order to the carrier. If your order arrives damaged or goes missing, contact the carrier first then contact us and we'll help.

6. Returns and refunds

Returns and refunds are covered by our Returns & Refund Policy.

7. Your account

You're responsible for keeping your login details secure and for activity on your account. Please keep your contact and shipping information current. We may suspend or close an account that violates these terms.

8. Subscriptions

If you sign up for a subscription, it renews automatically and we'll charge your payment method and ship your order at the interval you chose until you cancel. The price, delivery interval and any subscription discount are shown before you subscribe and in your order confirmation.

You can skip, pause or cancel at any time from your account, or by emailing info@dakbar.com. To stop the next order, cancel before its billing date. Canceling stops future orders; orders already billed will ship as normal. If we change the price or terms of your subscription, we'll notify you before the change takes effect, and you can cancel before it applies.

9. Wholesale accounts

Wholesale accounts are for retailers and other businesses we approve. Wholesale pricing, minimum orders (4 cases initial order, 2 cases for reorders) and payment terms (Net 30 for approved accounts) are set out in your account and may change with notice. Wholesale products are for resale or business use. We may change or close a wholesale account at our discretion, including for overdue payment.

10. Reviews and other content you submit

If you post a review or send us content, you confirm it is your own honest opinion and that you have the right to share it. You give us a non-exclusive, royalty-free, perpetual license to use, display and share it in connection with Dak Bar, including in marketing.

Don't post content that is false, misleading, defamatory, obscene, abusive, infringing or unlawful, or that advertises other businesses. We don't review everything posted, but we may remove any content at our discretion.

11. Intellectual property

The content of this site, including text, photos, graphics, logos and code, belongs to Dak Bar or its licensors and is protected by copyright and trademark law. "Dak Bar" and our logos and product names are trademarks of Dak Bar Whole Foods, Inc. You may view and print pages for your personal, non-commercial use or to place an order. Any other use requires our written permission.

12. Third-party links and services

The site uses services from other companies, such as our payment processors, review platform and store locator, and may link to other websites. We don't control these and aren't responsible for their content or practices. Your use of them may be subject to their own terms and privacy policies.

13. Disclaimer of warranties

Except as stated on product packaging or required by law, the site and our products are provided "as is" and "as available." To the fullest extent the law allows, we disclaim all warranties, express or implied, including implied warranties of merchantability, fitness for a particular purpose and non-infringement. We don't promise the site will be uninterrupted, error-free or free of viruses or other harmful components. Some states don't allow these exclusions, so they may not apply to you.

14. Limitation of liability

To the fullest extent the law allows, Dak Bar is not liable for any indirect, incidental, special or consequential damages arising from your use of the site or our products, even if we were told such damages were possible. Our total liability for any claim relating to an order is limited to the amount you paid for that order. Some states don't allow the limitation or exclusion of liability for incidental or consequential damages, so these limits may not apply to you.

15. Indemnification

You agree to indemnify and hold harmless Dak Bar and its officers, directors, employees and agents from claims, losses and costs, including reasonable attorneys' fees, arising from your violation of these terms or your misuse of the site.

16. Governing law and disputes

These terms are governed by the laws of the State of New York, without regard to conflict-of-law rules. The 1980 U.N. Convention on Contracts for the International Sale of Goods does not apply. Any legal action relating to the site or our products must be brought in the state or federal courts serving Essex County, New York, and you consent to their jurisdiction. Any claim must be brought within one (1) year after it arises, unless the law requires a longer period.

We want everyone to be able to use our site. See our Accessibility Statement, or contact us if you need help placing an order.

18. General

These terms, together with the policies linked above, are the entire agreement between you and Dak Bar about the site and your purchases. If any part is found unenforceable, the rest stays in effect. Our not enforcing a provision is not a waiver of it. We may assign our rights and duties under these terms. We may send you notices by email, on the site, or to the address you gave us.
